Investigators believe human remains found east of Enid in rural Garfield County on Saturday may be those of the missing woman, Assistant District Attorney Richard Sitz-man said. Mirich will be charged with first-degree murder, Sitzman said. Authorities did not release the name of the woman Mirich is accused of killing. Sitzman said investigators are waiting for a report from the state medical examiner's office before releasing a name.

"We believe the murder case is connected to the body found in Garfield County, but we cannot 100 percent say that until the body has been identified," Sitzman said. An Aug. 12 house fire in northeast Norman may be related to the case, Sitzman said. Based on a tip, investigators from the Garfield County Sheriffs Department, the Enid Police Department and Norman police searched the land where the body was found, Sitzman said. Arrested was John Kevin Berry, 38, of Oklahoma City. According to a police report: An officer stopped a car at 2:45 a.m. Monday in the 6500 block of Northwest Expressway after seeing it weave as it was headed north on the Lake Hefner Parkway. The driver smelled of alcohol.

The driver told the officer he "had a couple of drinks, but that was some time back." Oklahoma law defines hate crimes as malicious actions designed specifically to intimidate or harass others because of race, color, religion, ancestry, national origin or disability.

Hate crimes include three areas of criminal offenses: Assault and battery; Property damage and vandalism; Threats to cause personal injury or property damage. Inciting violence against others also can be considered a hate crime. Hate crime convictions are misdemeanors, punishable by imprisonment of up to one year and a $1,000 fine. A second conviction is a felony punishable by up to 10 years in prison and a $10,000 fine. Twenty-two states, including the District of Columbia, have hate crime laws that protect sexual orientation; 20 states have hate crime laws that exclude sexual orientation, including Oklahoma.

A case study In 2004, Amnion Reich was accused of inciting a racially charged altercation between two groups, leading to an accident in which Joseph Tusan, a black football player at East Central University, died.

Among other things, Reich was accused of shouting racial slurs at Tusan and other blacks. Rather than seeking a hate crime conviction, though, Pontotoc County prosecutors sought and obtained a conviction on more serious charges. Reich was convicted of second-degree murder and 32 counts of assault. Few seem surprised the statute isn't being applied to more cases. Kevin Cox, the Oklahoma City Democrat who co-authored the measure in 1991, disagrees with Moon and Newman.
